Operating under the influence is a crime involving drinking and driving. OUI means either or both of two things:

First, Operating Under the Influence(OUI) is operating or trying to operate a motor vehicle while under the influence of intoxicants. "Intoxicants" are many different substance, including alcohol, illegal drugs and prescription drugs. A person is under the influence if their mental or physical state are impaired to slightest degree, despite of whether it affects the actual operation of the motor vehicle.

Second, OUI is operating or attempting to operate a motor vehicle while having a blood alcohol content (BAC) of .08% by weight or more, regardless of whether that level of alcohol affects the person.

  • That breaks down to 500 fatalities every week,
  • 70 OUI-related deaths daily, and
  • 1 American death every 20 minutes.
  • 50% of Americans will be involved in an OUI-related accident at some point in their lives.
