DUI

DUI (driving under the influence) is a major problem throughout the United States, and is responsible for causing up to 39% of all driving fatalities. It is estimated that a person who has been drinking is six times more likely to be involved in an accident. In fact, DUI-related fatalities are the leading cause of death for Americans age 16-24. In order to be guilty of a DUI, a driver must have a blood-alcohol level (BAC) of 08%. In some states, there are lesser penalties for anyone having a BAC of .05%. And all states have a zero-tolerance policy for anyone under 21 with any alcohol in their system, with those drivers immediately having their licenses suspended. If a driver is found guilty of a DUI, most cases are classified as misdemeanors, although more severe cases and cases involving repeat offenders do carry felony convictions and stiff penalties. In order to test drivers, police can conduct field sobriety tests on the scene. Police also can administer a portable breath analyzer. And, most often with a Judge's permission, police can draw blood from a jailed suspect to determine the BAC.
