DUI laws are in place to effectively increase highway by reducing drunk driving accidents and fatalities. When a person drives while intoxicated, and is arrested, fines, penalties, and prison time are harsh in order to deter a second incident and send a message to the public. At the DUI hearing, the DUI judge will determine guilt or innocence, and impose a sentence, which may include fines, incarceration, community service, driver's license suspension or revocation, restitution and rehabilitation. The sentence is based on many factors, such as statutes, sentencing guidelines, the judge's discretion, past convictions, and the judge's belief regarding whether the defendant is likely to be rehabilitated.
