DUI, or Driving Under the Influence, is a Class C misdemeanor, usually reserved for underage drivers with any amount of alcohol in their blood. A DWI, Driving While Intoxicated, is a Class B misdemeanor, chargeable regardless of age where the driver has lost control of his or her mental or physical capabilities and registers a blood alcohol concentration over the legal limit of 0.08%. DWI carries jail time and heavy fines that are harsher than a DUI conviction.
