The penalty for a DUI (driving while intoxicated) is dependent on the nature of the charge and the state the charge was in. It is also dependent on the age of the driver, as any driver under 21 faces national zero tolerance laws. Most minor DUI charges, especially for first time offenders, are classified as misdemeanors and carry simpler sentences, such as fines, a briefly suspended license, and enrollment into an alternative sentencing program, such as an alcohol education program. For the more serious charges, drivers with multiple prior convictions and drivers, who refuse to take field sobriety tests (in some states), the penalties can increase greatly. If a major accident or fatalities have occurred, the penalties are among the stiffest in the criminal system. Jail time, felony convictions and large criminal and restitution fines are a major part of these penalties.
