What is the difference between a DUI and DWI? DUI is driving under the influence, while DWI is driving while intoxicated, but how do the two differ? Depending on the state, the difference between the two can change - while with some states, they both mean the same thing. Generally, getting charged with a DUI or DWI means you were driving while under the influence of drugs or alcohol. To be charged with a DUI or DWI due to the influence of alcohol, your BAC (Blood Alcohol Content) has to be .08 or .10, depending on which state you are in. How do you get charged with a DUI or DWI? The reasons you would get pulled over in the first place could vary. It could be something as simple as speeding, or that your intoxication is obvious in your driving. It could also just be at sobriety checkpoint. The law simply states that anyone under 21 that has been drinking, regardless of their BAC, would be charged with a DUI/DWI due to the fact that it is illegal for them to be drinking in the first place. The law is quickly spreading through other states. Additionally, serving alcohol to someone that is under 21 who gets charged with a DUI/DWI will get you in trouble as well if it is traced back to you. Even simply having an open alcohol container that you are not consuming can get you in trouble as well.
