It really depends on what type of DUI you are charged and convicted of. DUI involving twice the legal BAC (.16) are greater than those involving below this threshold (.08-.15). Furthermore, if there was an accident, injury or fatality, you could be looking at an entirely different sentencing schedule.
At the very minimum, CA law imposes (1) a term of probation not less than three years nor more than five years or a period equal to the maximum permissible sentence; (2) A requirement that the person not drive a vehicle with any measurable amount of alcohol in his or her blood; (3) A requirement that the person not refuse a chemical test for the purpose of determining blood-alcohol content on arrest for a violation of certain vehicle codes; and (4) A requirement that the person not commit a criminal offense.
