I got my 2nd DUI while on a provisional license, is my license going to be suspended?

Question: I have been on a provisional license because I had a DUI before. I am in California. I just got pulled over for my 2nd DUI last week and I am awaiting my court hearing. Is my license going to be suspended or can I still have it provisional?

Response by Pratul Lakhotia: Recieving a 2nd DUI in almost any state is taken very seriously considering the countless wrongful death cases that have arised as a result. You will almost surely face jail time and fines, and the license will more than likely be suspended for up to 1 year. However, you should hire a DUI attorney to review the details of your case to see if there would be any defense options. One important thing to know is how far apart the DUI charges were (within 6 months, 1 year?), and where your BAC level was at. A skilled attorney may be able to work out a deal with the state and possibly remove jail time, while allowing you to continue to have a provisional license perhaps just to get to work. Consulting with an attorney would be the first step in the right direction.
