In Arizona, a driver is charged with extreme DWI or DUI when his or her blood alcohol level is .15% or more within two hours of operating a motor vehicle.  Extreme DUI or DWI  is considered a class 1 misdemeanor and carries the following penalties:

  • A minimum 30-day jail sentence;
  • A maximum 6-month jail sentence;
  • A $250 minimum fine (as well as a surcharge);
  • A $1000 assessment (allocated to the Arizona Prison Fund) and a $250 assessment (allocated to the state's DUI Abatement Fund);
  • Drug/alcohol screening and counseling; and
  • 5-year maximum probation.

Second-offense extreme DUI in Arizona subjects the intoxicated driver to the following penalties:

  • $500 fine, in addition to $1250 for arrest, a $250 assessment which is allocated to the state's DUI abatement fund, and a surcharge;
  • Revocation of driver's license for a period of one year;
  • A 120-day jail sentence;
  • Potential placement on probation for up to five years;
  • Counseling (allowd in some cases); and
  • Installation of an ignition interlock device on the vehicle.
