Question:

I was driving a short distance on a road to a lake on a large piece of private property that my Uncle owns. It is adjacent to a public park. I was caught by a police trooper that pulled me over and gave me a DUI. Is there anyway to get out of this charge considering it was on private property?

Answer: (1)

Generally speaking, you can still get pulled over and charged for a DUI even though you are on private property. However, there have been cases where skilled drunk driving attorneys were able to get this type of charge removed. It is relative to the state's laws and jurisdictions on DUI/DWI that you reside in. Consult with a DUI Attorney immediately.
