Many people mistakenly think that failing a breathalyzer test means you will be convicted of driving under the influence, but if you are thinking, "Can a DUI be dismissed with no penalties", the answer is yes. If your case is dismissed, you should expect that all associated penalties will be eliminated because you will never be sentenced.
One exception to this as it pertains to DUI cases can be drivers license suspension. In most states, a DUI conviction can involve a court procedure and an administrative procedure handled by the state's Department of Motor Vehicles. If you refused to submit to a requested breathalyzer test you violated your the implied consent laws in your state which resulted in an immediate and automatic suspension of your drivers license.
If your DUI case is dismissed from the criminal courts, your attorney may be able to get your license suspension if you refused the breathalyzer, but this will be a separate legal proceeding.
Obtaining A Dismissal
If your attorney can file a successful motion convincing a judge that insufficient probable cause existed to pull you over in the first place, your case will be dismissed before going to trial.
If you do go to trial, you will not automatically be convicted. A jury of your peers may find you not guilty after deliberating over the evidence. If that happens, there will be no penalties.
