Question:

What should I consider when choosing a DUI lawyer?

Answer:

When you are arrested for drunk driving, lawyers and how to select the right one quickly become extremely important. Although you need to make your selection as quickly as possible, there are several things you should take into consideration. Use these questions as a guideline help you find the right DUI lawyer:

1.  What percentage of your practice is devoted to defending people against drunk driving charges?

  • Ideally, try to select an attorney who devotes at least a third of their practice to specializing in drunk driving defense. You want someone who is intimately familiar with this area of the law and the law enforcement processes that are associated with it.

2.  How many years experience do you have specializing in drunk driving defense?

  • How you feel about the answer to this question is purely subjective, but at least you should know if the attorney you are about to hire has specialized in this field for 6 months or 16 years.

3.  Will the attorney you are meeting with be the one representing you, or will someone more junior in their firm be handling most of the aspects of your case?

  • Make sure your expectations line up exactly with the services offered by the attorney and their firm. If you are not comfortable dealing with anyone other than the person you are talking to, make that clear up front. Be sure you understand how your case will be handled.

4.  What is your fee structure?

  • Your initial consultation is likely to be free, but you must be informed about what the fees are and the potential costs.

Resist the urge to be dazzled by an impressive win/loss ratio, as this does not tell you anything about the complexity of the cases the attorney has won. Instead ask a question like, "What was the hardest DUI case you ever won?" or "From what I have told you about my case, what do you think will be the hardest thing about defending me?"

Contacting an attorney who specializes in drunk driving is critical for your future. Your license, driving record, and possibly your job and freedom depend on making the right choice. Ask questions and find someone you are comfortable with and believe in.
