Question:

What are the sentencing guidelines for a DUI for someone under 21?

Answer:

The criminal penalty for DUI under 21 is State specific.  Each State will have enacted its own specific criminal penalties that may be imposed against a driver convicted of operating a vehicle under the influence of drugs or alcohol that is under age twenty one.  Below is the law for one State to provide an idea of how a DUI may be handled concerning an operator under age twenty one years but check on the law specific to the State where you live to be sure of the law that may apply to your situation.

First Offence

If an operator was under the age of twenty-one when the driving under the influence offense was committed, the person’s license or right to operate shall be suspended for two hundred and ten days, and that operator will be assigned to a program specifically designed by the State department of public health for the education and treatment of drivers convicted of operating a motor vehicle after or while consuming alcohol, controlled substances or the vapors of glue.

Breath Test Criteria

If the breath test result for an operator under age twenty one is not less than .20 then the “first offender program” is not available to that individual and he or she would have to attend a rehabilitation program known as the “14 day second offender in home program.”

Getting Legal Help

It is always best to have the assistance of counsel when charged with a serious crime especially if the individual is under age twenty one and is possibly unfamiliar with the requirements of their State’s criminal justice system.
