In the State of California, any driver who is caught operating a motor vehicle with a blood alcohol content (BAC) of .08 or higher is considered legally drunk. The penalties for being convicted for driving under the influence (DUI) can include mandatory jail time; loss of your driver’s license and you may be required to pay huge fines. The CA drunk driving laws were recently amended. As of July 2010, any person convicted of a drunk driving offense in Alameda, Los Angeles, Sacramento and Tulare counties will be required to install an ignition interlock device in their vehicle.

California Commercial Driver DUI Laws

The DUI laws in California hold commercial vehicle operators and drivers under the age of 21 to much stricter standards. Any driver who operates a commercial vehicle, such as a big rig truck or school bus, can be arrested is their BAC is .04 or higher. Upon conviction of a first offense, their commercial driver’s license will be revoked for a period of one year. The penalty will be enhanced to a three-year revocation if the driver was operating a commercial vehicle that was transporting hazardous materials at the time. If they are convicted of a second offense, they may lose their license for life.
