In order to get the case dismissed, you will need to mount a successful defense to the DUI and you will need to prove that the charges against you cannot be upheld legally. There are a number of potential DUI defenses that you can use to attempt to get these charges against you dismissed. For example, you can argue:

  • That the police had no probable cause and thus the evidence they collected against you should not be admitted. If they pulled you over for no reason and had no reason to suspect you were driving drunk, then this is considered an illegal search and the evidence against you will not be admissible
  • That your BAC was not actually above the limit at the time you were driving drunk. Since your BAC keeps rising for a while after you stopped drinking, if you weren't tested right away, this defense can be a good option
