However, although you are required to undergo testing, you do have rights when you are suspected of a DUI. If you are suspected of a DUI:

  • Be polite to the officer who pulled you over, but do not volunteer more information than necessary. You don't want to be rude or aggressive as this can escalate the situation, but you also don't want to give any details that could incriminate you. Remember, the police must have probable cause to test you for alcohol in your blood and the more you talk or share, the more chance you have of giving them probable cause
  • Request a blood test if they are going to give you a test. Field sobriety tests are widely viewed as the least reliable method of testing, and breathalyzers may be flawed as well. A blood test is the surest indicator of whether you are actually above the legal limit
