What are the penalties for a first DUI in Colorado?

Answer:

Like other states, Colorado will prosecute drivers who are found to be driving with blood alcohol content BAC of 0.08% or more.  Under Colorado DUI laws, f a driver has such a BAC, they can face criminal prosecution based on that fact alone, without having necessarily exhibited poor driving. 

First DUI offenses in Colorado can carry a variety of serious penalties, including: 

  • At least very least, probation for 1 or 2 years.  This probation, in the least serious sense, may not be supervised.
  • Community service for 2 days or more
  • Evaluation by drug and alcohol programs and possible treatment
  • A drug education course administered by the state, but paid for by the driver
  • Fees, fines, and court expenses which can reach up to $500
  • Required abstinence from drugs and alcohol for one year

If you are facing a second or third DUI charge, the penalties get even more serious.  You will pay greater fines, lose your license, and spend more time in jail. 

In Colorado’s most serious DUI cases, you can:

  • Spend a year in prison
  • Have 4 days of public service required
  • Submit to 86 hours of drug and alcohol treatment
  • Required jail time
  • Pay a $1,000 fine
  • Lose your license or vehicle
