What are the penalties for a second DUI in Washington State?

Answer:

Under Washington DUI laws, you are guilty of a DUI in Washington state if you are over 21 and have a blood alcohol content (BAC) of 0.08% or higher.  If you are under 21, you have a DUI if your BAC is 0.02% or higher.  All DUI penalties are more severe if you drive with a BAC of 0.15 or more. 

If you are facing a second DUI offense in Washington State, penalties include: 

  • Prison sentence of 30 days or up to one year, with 2 months of electronic monitoring at home. 
  • If you BAC is less than 0.15%, you will pay fine of $500 - $5,000.  If you BAC is over 0.15% you will pay between $750 and $5,000.  If some arrangement is made where you are convicted of a less serious charge, you can pay only $125 in certain instances.
  • You may also face mandatory drug treatment and education classes, community service, probation, and other court-ordered penalties
  • Your license will be suspended for 2 years if you are over 21 with a BAC below 0.15%. If you are an adult with a BAC over 0.15%, you will have your license suspended for 900 days.  If you are 21 or under, and your BAC is lower than 0.08%, you will lose your license for one year or until you are 21, whichever time period takes longer.
