What is the penalty for a first DUI in Oklahoma?

Under Oklahoma DUI laws, it is illegal for a person to operate or be in actual physical control of a motor vehicle with a blood alcohol concentration (BAC) of .08 percent or above. The .08 measure is the federal benchmark. However, Oklahoma has lower BAC limitations where the offender is either a driver of a commercial vehicle or where the driver is under the legal drinking age of 21. Below are penalties for conviction of a DUI in Oklahoma:

1st DUI Conviction

  • Jail time from 10 days to 1 year; under Oklahoma's child endangerment laws; if a minor child is in vehicle, jail term up to 4 years
  • Fine up to $1,000; if a minor child is in vehicle, the fine amount is doubled
  • License suspension of 30 days
  • Participation in mandatory assessment and evaluation for treatment
  • Additional DUI fines of $300 minimum

2nd DUI Conviction

  • Jail time from 1 to 5 years and/or treatment; if a minor child is in vehicle, jail term up to 4 years
  • Fine up to $2,500; if a minor child is in vehicle, the amount is doubled
  • License suspension of 6 months
  • Ignition interlock device placed on vehicle
  • Participation in mandatory assessment and evaluation for treatment

3rd and subsequent DUI Conviction

  • Jail time from 1 to 20 years; if a minor child is in vehicle, jail term up to 4 years
  • Fine up to $1,000; if a minor child is in vehicle, the amount is doubled
  • License suspension of 1 year
  • Ignition interlock device placed on vehicle
  • Up to 480 hours in community service
  • One year supervision along with periodic testing
  • Participation in mandatory assessment and evaluation for treatment
