As with other states, Louisiana defines DUI as anyone driving with a blood alcohol content (BAC) of 0.08% or more. This “per se” standard means that you are guilty of a DUI with this BAC level in the eyes of the law, even if your driving is not seemingly impaired.
Also as in other states, the Louisiana DUI penalties get more serious if your BAC is over a particular threshold between 0.15% and 0.20%. This enhanced penalty level means that you will have stiffer punishment and fines, and longer prison sentences and license suspensions if you are found to be driving with BAC levels this high.
Louisiana also has zero-tolerance policies for under-age drinking in drivers under the age of 21. In these instances, the BAC can only be at negligible levels of 0.01 to 0.02%. These drivers face stiffer penalties as well.
