Individuals who are arrested for driving while intoxicated (DWI) may face penalties including jail time and large fines. The Arkansas DWI penalties for anyone charged with the offense will automatically lose their driver’s license. In the interim, you will be issued a paper license, which is only good for a period of 30 days. You must request a hearing at the Department of Motor Vehicles (DMV) within 7 days in order to contest the suspension of your license.
DWI Penalties in the Hot Water State
Arkansas may be known for its’ abundant hot springs, but motorists who are convicted of a DWI will face some hot water of their own. All first-time offenders will be required to install an interlock ignition device in their vehicle. Driver’s who elect to have an ignition interlock device installed may avoid having their license suspended for six months. The individual must appear at an administrative hearing to request an interlock-restricted driver’s license. If the license is granted, the individual will be restricted in where he or she will be allowed to drive.
What is an Ignition Interlock Device?
An interlock device works by requiring the driver to blow into a breath alcohol analyzer that is attached to the ignition system of the vehicle. If any amount of alcohol is detected, the vehicle will not be able to start. The driver will also be required to blow into the device while driving at random intervals. The company who installs the device must calibrate the equipment every 30 to 60 days. They are also required to report any traces of alcohol that was recorded in the device. The installation fee will cost around $150 with a payment of $60 each month to rent the device.
