Under Mississippi DUI laws, it is illegal for you to operate a vehicle while under the influence of drugs or alcohol. Intoxication within the state is defined as a blood alcohol content of 0.08% or higher.  These are the some of the specific penalties for a first-time DUI in Mississippi: 

  • You may be sentenced to up to 2 days in prison.  Depending on the specific circumstances in your DUI case, you may be able to simply pay fines instead of serving jail time.  In some cases, you may have jail time exchanged for time you spend serving on what’s known as a victim impact panel in Mississippi.
  • In addition to jail considerations, you may have to pay between $250 and $1,000 in fines for a first DUI offense, in addition to court fees.  The court may have you spend time in jail instead of paying fines.  In these cases, you will still have to pay court fees.
  • For your first DUI, you will lose your license for at least 90 days.  You may lose your license for a longer period of time if you damaged property or hurt others while driving under the influence.  The time you lose your license begins after your jail term ends, not while you are in jail.
