Answer:

As with other states, Maine sets the “per se” standard for Operating Under the Influence (OUI) at a blood alcohol content of 0.08% or more.  In other words, if your blood or breath test shows that your BAC is 0.08% or more, you are immediately seen as guilty of an OUI in the eyes of the Maine DUI laws. 

In these cases, you will immediately lose your license.  Consider these factors in Maine OUI penalties: 

  • The Secretary of State in Maine suspends your license based on these factors immediately, even before you have gone to court.  You will need to remember that you cannot drive with a suspended license as you await your court date.
  • If you are found to be an underage drinker, with a BAC over the negligible limit of 0.02%, you will lose your right to drive in Main for one year.
  • If you refuse to have your BAC tested, Maine withholds the right to immediately suspend your right to drive.  Maine can prevent you from driving in that instance for up to 18 months because Maine, like other states, holds your license as a privilege not a right.  This privilege can be revoked on the spot.
