If you are arrested for a driving while under the influence of drugs or alcohol (DUI) in New Jersey, the specific penalties that you face will depend on how many other times you have been arrested for DWI.  

If this is your first offense, under the New Jersey DWI penalties, you will face:

  • Fines ranging from $250 to $400
  • Attendance at Intoxicated Driver Resource Center (IDRC) alcohol awareness courses.  You will need to attend these courses for somewhere between 12 and 48 hours.  There is also a $100 fee to attend these courses.
  • Penalty of $50 to the Violent Crimes Compensation Board (VCCB), as well as a Safe Neighborhood Fund Assessment of $75.
  • Possible 30-day prison sentence.
  • Loss of your NJ drivers’ license for 6 months up to a year

If this is your second offense, you will face:

  • Fines between $500 and $1000.
  • 30 days of mandatory community service.
  • Courses and fees through the IDRC, as well as VCCB and Safe Neighborhood fees.
  • Jail term of between 2 and 90 days.
  • Revoked driving privileges for 2 years.

For third strikes, you will:

  • Pay a $1000 fine
  • Attend IDRC courses for between 12 hours and 48 hours, and pay associated fees
  • Pay VCCB and Safe Neighborhood fines
  • Face 180 in jail
  • Lose your NJ license for 10 years.
