Can I appeal the suspension of my license for a DUI in the state of Ohio?

Under Ohio DUI laws, your license may be suspended in two separate ways:

  • It may be suspended as part of an automatic administrative action by the DMV. This means if you get arrested for DUI, your license is automatically lost. 
  • It may be suspended as part of your sentencing after a criminal trial where guilt is proven and you are officially found guilty and issued penalties by a judge

If you have your license suspended by the DMV as an administrative action, you may request a hearing after a 15 day period where you try to convince the DMV to reinstate your drivers license before the term of the suspension would normally be up. You may request that you get your license back on a temporary basis or that the entire suspension be overturned. However, even if you are successful at getting the DMV to give you back your license, the court can take it away again as part of your DUI sentence.
