This means that as soon as you are pulled over and arrested for a DUI, your license is suspended by the Department of Motor Vehicles. If this happens to you, then you may wonder how you can go about getting your license back while your criminal DUI case is pending.
There is a way to do this, although you may not necessarily always be successful at getting your license reinstated. To try to get your license back, you will need to request a DMV hearing. Typically, you have a specific time limit in which to make this request. This hearing is separate from any criminal actions pending against you, and involves appearing before an administrative judge to make an argument as to why your license should be returned. Of course, it is important to note that even if you get your license back at the DMV hearing, your license can be suspended again as part of your criminal sentence.
