My license was taken away for a DUI in Louisiana. How do I contest the suspension?

Louisiana DUI laws impose serious penalties on those who are found to be driving with a BAC above the legal limit. One of those penalties is the loss of your license. In fact, in Louisiana, there are actually not one but two ways in which you may lose your drivers license:

  • The DMV suspends your license automatically after an arrest. This administrative DMV suspension lasts for a period of 90 days minimum, depending on the number of offenses
  • You may also have your license suspended or even revoked (for multiple offenses) by a judge as part of a sentence once you have officially been found guilty of DUI charges.

When you receive an administrative suspension, you do have the right to request a DMV hearing to appeal that suspension. You may request reinstatement after 30 days, and you may request either a restricted license or full reinstatement. However, you will need to convince the DMV that there is a legitimate reason you should have your license back. Furthermore, even if the DMV gives you your license back, your license may still be suspended as part of the sentence for the criminal charges against you.
