If you were charged with a DUI in a state other than the one where you live and you are hoping that you will face less severe consequences, do not let your hopes get too high. Driver’s license suspension is a common consequence for DUI offenders and being convicted in another state doesn’t generally allow a person avoid it.
Driving Privileges For Out Of State DUI
In the US, there are a number of national databases that maintain information about traffic violations. This allows authorities to find out information about drivers from other states and to report violations that occur when individuals are outside of their home borders.
Most states are parties to the Driver’s License Compact (DLC). This not only gives them access to a national database, it also obligates them to an agreement. That agreement says that violations committed in other states will be treated as if they were committed in a person’s home state. This means that if your state is a member of the DLC, they can’t simply ignore a DUI conviction because it didn’t happen on their highways. If the state where the violation occurred normally imposes a period of driver’s license suspension for a DUI, it is likely that you will lose your driving privileges.
Legal Assistance
Out of state DUI charges should not be ignored or neglected. You should contact a drunk driving attorney in the state where you are accused of drunk driving. Find out if that state is a member of the DLC and what options you have to protect your driving privileges.
