I got a DUI for cough syrup and I was sick, do I have a defense?
Was told i had no choice but to submit to probable cause because i gave someone a ride. I had been drinking cough syrup all day as i have a cold and had been about a mile from my home. They are now trying to take my license away.

Many state laws have statutes which classify even medicine such as cough syrup to be within the same grounds of a DUI conviction. However, there are many factors to take into consideration and consulting with a Lawyer would be recommended. Even though the cough syrup may have been in your blood, it does not necessarily mean you lose the case. You should agree to field sobriety and breathalyzer testing as requested by the officer. Laws vary from state to state so you should consult with an attorney and answer all of his/her questions.
