I was coming home from happy hour and I unexpectedly had to pick my brother up from karate class afterwards. I didn't have that much to drink, just a couple of beers. After I picked up my brother, he is 12, I was pulled over by a cop and tested for a DUI. I blew a .09 and I got out of jail on bail and am awaiting a court trial. What type of consequences will I face having my brother in the car? This is my first DUI.

In Massachusetts, along with many other states, driving with a minor in a vehicle while recieving a DUI is additionally charged with Child Endangerment. That gets you additional penalties of jail time from 90 days to 2.5 years and/or $1,000-$5,000 fine.

1st time DUI offense in Massachusetts, aside from the additional Child Endangerment penalties include:

  • Fines from $500 up to $5000
  • Up to 2 ½ years of prison for a first offense!
  • Driver's license suspension for 1 year
