What is a look back period on a DUI? How long do DUI charges stay on your record?

Question: I just got a 3rd DUI in 20 years. The first two were about 19, and 20 years ago. My court date is coming up soon. Will those other 2 DUIs still impact me in having my penalties assessed? How does this work?

Response by Matt Placek: Each state has their own "look back" period for DUI convictions. A "look back" period is basically a period of time a State will look back at for prior DUI convictions in order to assess the minimum penalties you will receive for the next DUI. To illustrate an example, in California the "look back" period in 2006 was changed from 7 years to 10 years. Thus, if you recieve 3 DUIs in a 10 year period, each preceding DUI charge will come with stiffer penalties and take into consideration the priors. However, if your charge was 15-20 years ago, you live in California, and you recieve your third DUI in your life time just now, the penalties would be similar to a first DUI offense.
