I got a DUI in a previous state 5 years ago. Will they count my out of state DUI in assessing penalties for a new DUI here?
I used to live in another state for pretty much the majority of my life and recieved a DUI over there 5 years ago. I shortly made a move out of state right after that. Unfortunately, I just got another DUI charge pending trial date. Will they use my previous out of state DUI in assessing charges and penalties?

Most computer networks used by Police and Law Enforcement agencies have access to viewing criminal records of suspects from out of state. Thus, they most likely probably will discover your previous DUI and use it in assessing stiffer penalties against you. However, each state has DUI statutes surrounding previous DUIs that were out of state, as well as "look back" periods on taking previous DUIs into consideration. You should consult with a DUI attorney immediately. They will help ensure your previous DUI does not get accounted for, and also fight to lower your penalties and avoiding jail time.
