Drunk Driver Kills Children in Accident

The 31 year old man from Danville who killed his 2 children in a drunk driving accident will stand trail for these charges on November 9, 2007.

Keith Heer is currently free on a $100,000 recognizance bond.

When he stands trial, Heer will face 2 counts of aggravated driving under the influence that killed his 2 year old daughter and 1 year old son.

In addition to a DUI offense, it has also been reported that Heer was speeding and driving without "regard to the existing traffic conditions and the safety of people" in the car.

The accident occured when he drove off the road into a guardrail.

Reckless homicide falls under a class 3 felony.  With this type of penalty, a person can serve up to 14 years in prison and pay a $25,000 fine.  Aggravated driving under the influence falls under a class 2 felony.  With this type of penalty, a person can serve up to 7 years in prison and pay a $25,000 fine.

Because of the severity of Heer's case, he could face up to 28 years in prison for each charged, if he is convicted.

Heer's car split in 2 when he hit the guardrail on June 22, 2007 at about 6:00pm.  Police suspect that the children were not properly secured in the car.  Both children died of blunt force injuries from the accident.
