Virginia 2008 DUI-Related Insurance Requirements and DUI Law Changes


Persons with convictions related to driving while under the influence are required to have double the minimum automobile liability insurance coverage limits, effective January 1, 2008.

Double the minimum automobile liability insurance coverage limits are now required for persons convicted of the following offenses:

Driving while under the influence of alcohol and/or drugs
Maiming while under the influence of alcohol and/or drugs
Driving while suspended/revoked for one of the above DUI-related offenses

This change applies to persons convicted of DUI-related offenses:

Prior to January 1, 2008 and required to continue filing proof of insurance with DMV beyond December 31, 2007
On or after January 1, 2008

The new insurance policy coverage limits must be at least:

$50,000 for injury or death to one person
$100,000 for injury or death to two or more people
$40,000 for property damage

Persons required to file proof of insurance beyond December 31, 2007 must obtain the coverage limits indicated above when their current policy is renewed or when their new policy is issued.

The financial responsibility form FR-44 serves as evidence to DMV that this coverage was purchased. Individuals are responsible for purchasing the required insurance coverage and having their insurance company file the FR-44 form with DMV. If DMV does not receive the FR-44 when the person's new policy is issued or when the current policy is renewed, DMV will suspend the person's privileges to:

Drive
Register motor vehicles in Virginia
Obtain decals in Virginia.
