Massachusetts OUI Laws And How They Differ From Other States

This law updates Massachusetts' impaired driving laws and finally brings Massachusetts into line with the other 49 states. It is now a crime (a "per se" violation of law) to operate a motor vehicle with a blood alcohol concentration of .08 or greater; if a driver's blood alcohol content (BAC) is .08 or higher, the law now presumes he is impaired. Henceforth, anyone arrested for OUI who takes a breath/blood test with a result of .08 may be found guilty under one of two theories - operating under the influence OR operating with a BAC of .08 or greater. The incentives to take a breath test have also been enhanced. The penalty for refusal to take a breath/blood test is now 180 days (increased from 120 days) and the penalty for taking the test and failing has been decreased to 30 days (from 90 days).
