If you drive a vehicle in Wyoming, you are agreeing to the state's implied consent laws. Under these laws, you are agreeing to take a chemical test to determine your level of intoxication if a police officer requests one. If you refuse to take this test, you will face a mandatory 6 month suspension of your driver’s license. If there are additional refusals after a first offense, you will face 18 months suspended license.

First DUI Offense

A first offense of Wyoming DUI laws will result in the following penalties:

  • Driver's license suspension for 90 days
  • Up to 6 months in jail
  • $750 fine
  • Substance abuse assessment before sentencing
  • Charged with a misdemeanor

Second DUI Offense

A second offense is charged if you are convicted of a second DUI within a five year period. Wyoming has a 5 year look back period.

  • Minimum of 7 days in jail, up to 6 months
  • Fines up to $750
  • License suspension for 1 year
  • Must have a substance abuse assessment before sentencing
  • Ignition interlock device may be required
  • Charged with a misdemeanor

Third DUI Offense

A third offense within a 5 year period will warrant the following penalties:

  • At least 30 days in jail, up to 6 months
  • 15 days may be suspended if you are in an inpatient treatment program approved by the court
  • Fines up to $3000
  • Substance abuse assessment is required
  • Driver's license suspension for up to 3 years
  • Ignition interlock device required
  • Charged with a misdemeanor

Fourth DUI Offense

A fourth offense within a 5 year period will result in the following penalties:

  • Charged with a FELONY
  • 2 years in jail
  • Fines up to $10,000
  • Substance abuse assessment required
  • Ignition interlock device required
  • Your license may be revoked indefinitely
