In Connecticut, you can be charged with DUI in two cases.
Chemical tests (such as blood tests, breath tests,
or urine) are not necessary to charge you with DUI. Rather, if you should any
impairment in your driving abilities or in a sobriety test, you can be charged
with dui. If a chemical test is performed, a blood alcohol level of 0.08
percent or higher is considered in violation of Connecticut DUI laws.
If your blood alcohol level is .16 or higher, this
warrants enhanced penalties.
Implied Consent
Laws
In the state of Connecticut, implied consent exists. This
means, if you drive in the state, you agree to take a chemical test if an
officer requests it due to suspicion of alcohol or drug impairment. If you
refuse this test, this may be admitted into a court of law during a jury trial,
as an admission of potential guilt. If you refuse a sobriety test, this may
result in a DMV suspension of
your license for six months.
Look Back Period
In Connecticut, there is a 10-year look back period. A
new DUI offense is considered a first offense if you have not been convicted of
any DUI charges in the last ten years. If you have, this would elevate the
Connecticut DUI penalties to second offense (or so on) charges.
Connecticut DUI
First Offense
For first time DUI offenses, the following Connecticut
DUI penalties are in place.
- Fines from $500 to $1000
- Jail time of 48 hours, up to 6 months, with a suspended sentence possible with 100 hours of community service in lieu of jail time
- 1 year full suspension of drivers license
- You will be charged with at least a misdemeanor
Connecticut DUI
Second Offense
In the case of a second offense, or a second DUI charge within 10 years of a
first charge, equates to the following penalties:
- Fine from $1000 to $4000
- Jail time of 120 days up to 2 years, and a 100 hours of community service
- Driver's license suspension for three years, or until you are 21 years of age, whichever is longer
- You will be charged with at least a misdemeanor
Connecticut DUI
Third Offense:
A third offense within a 10-year period will result in
the following Connecticut DUI penalties:
- Fine of $2000 to $8000
- Jail time of 1 year, up to 3 years, with a mandatory 100 hours of community service
- Permanent revocation of driver's license
- You will be charged with at least a misdemeanor
Per Se Charges Through DMV
In Connecticut, additional charges may be brought by the
DMV. Consider the following circumstances.
1. If you refuse to submit to a chemical test (urine, blood or breath test) this will result in a 6 month, 1 year or 3 year suspension of your driver's license, for each consecutive offense.
2. If your tests are .02 or higher, and you are under 21 years old, a first offense results in a 90 day suspension, a second offense in a 9 month offense and a third offense in a 2 year revocation.

For those who have a blood alcohol level over .16 percent, a first offense will result
in 120 days license suspension, a second offense, 10 months of suspended
license and a third offense results in 2 ½ years of license revocation at
least.
