In 2008, the fatalities from drunk-driving related vehicle accidents totaled 11,773. The increased perception of driving while drinking as a serious problem has, in the past 2 decades resulted in tightening of the legal limit of blood alcohol – blood alcohol content (BAC). It has also produced another classification of driving under the influence (DUI) in 39 states and the District of Columbia. This is Extreme DUI.

Defining Extreme DUI

DUI is generally defined as having a BAC level of 0.08 while operating a motor vehicle. To obtain an extreme DUI, an individual must have a BAC that is significantly higher. In general, the BAC for an extreme DUI falls between 0.15 and 0.20. Depending upon the State, the vehicle in question can be a snowmobile, a car, a truck, a bus a motorcycle or even an ATV.

Basic Consequences

The severity of the consequences will differ from state-to-state. The specifics vary between Arizona, California and Virginia. All states, however, offer similar costs or penalties for extreme DUI. These include the following:

  • Jail time –It can range from 30 days to several years. It depends upon state legislation. In Virginia, for example, extreme DUI results in a year in jail
  • Fines – The fines for extreme DUI are significantly higher than those for a normal DUI. In Arizona, the minimum initial fine is $250 with additional causes for prison construction fees (app. $1,000), and a $250 minimum abatement fee. The fee in Virginia is a minimum of $2,500
  • Court Costs – including lawyer fees, bail, and related expenses, an extreme DUI charge can be costly
  • Probation periods – after serving jail time, typical probation periods are of longer duration
  • Required classes – An extreme DUI brings with it mandatory classes and education as well as possible drug testing, counseling and related material. This is costly in terms of time, energy and money
  • Driver’s license sanctions – If you have an extreme DUI, you will have a suspended license, you may have an ignition interlock device attached to your vehicle.

Other Consequences
